Nintendo’s Guidelines May ban Streamers

Nintendo’s aggressive approach to protecting its IP is nothing new, but the company is once again in the spotlight as its updated guidelines put streamers and content creators at risk of permanent bans.

The "Online Video & Image Sharing Platforms" guidelines, first introduced in 2018 and frequently updated since, have been refreshed again. The latest update grants Nintendo the authority to object to and permanently ban users who showcase its content in an unlawful, infringing, or inappropriate manner.

These rules pose significant risks for creators, as they are subject to strict conditions set by Nintendo. According to an FAQ on the guidelines page, content obtained through data mining or similar methods is strictly prohibited from being used in videos or live streams.

-Features video, images, sound sources, etc., that cannot be used in regular gameplay, extracted through game software via data mining or other methods."


Nintendo has never been lenient when it comes to enforcing IP rights. Just a few months ago, the company issued a legal notice against the popular Switch emulator, Yuzu, leading to its takedown.

Known for its stringent policies, Nintendo’s recent updates are no exception, extending beyond popular platforms like YouTube, Instagram, and Twitch. This suggests the company is ramping up efforts to tackle major leaks in the gaming industry.

Leaks often originate from data mining and encrypted game files, spreading through unofficial channels and revealing game secrets and unannounced features ahead of their official release.
